If I got into a car accident in CA over 2 years ago and I had no insurance, am I still liable? See details...?
The other driver had an uninsured drivers insurance policy in addition to his general policy and he said he wasn't going to come after me and we actually parted ways on good terms. I had to pay a fine of $700 dollars and had to correct the offense in court, so I am square with the state. His insurance covered his costs and and I was out of luck, lesson learned. But just today I got a call from a debt collector, (I got three or four calls in late 05, early 06 thinking it was a mistake) calling on the behalf of state farm saying that I owe state farm almost $4000. I never have received documentation and the guy wants a SSN and a CC number over the phone. If the guy had the insurance for uninsured drivers and it has been 2 1/2 years(3 in July, 08) am I liable for anything or is state farm just trying to cover their loss? how does statute of limitations apply to my situation? Any qualified info would be a great help.
You are liable. When you are driving without insurance and you get into an accident and you are at fault. The other person sues their own insurance under their Uninsured Motorist portion of their policy.....their insurance pays. All the money they paid out because of you, they will sue you for it. And that's what's happening. If you don't pay, they'll reduce this debt to a Judgment which will remain on your credit report for 20 years until it is satisfied. If after 20 years you still have not paid, they can reinstate it for another 20 years. I'm pretty sure they've covered themselves on the statute of limitations because in order for them to subrogate, they had to put this case into suit. Meaning they are covered.
I suggest you contact the collection agency and see if you can work out a deal with them. Also I don't know if 4K was for repairs only. If he's suing for bodily injuries....you'll be getting another notice later on.
Protect yourself.....don't drive without insurance.
